Terms of Service

§ 1 Scope These Terms of Service apply to the use of the MFEM software-as-a-service platform, provided by MFEM GmbH (in formation), Munich, Germany. § 2 Subject of Contract MFEM offers a cloud-optional, natively running FEM calculation software on macOS as a SaaS solution. The scope of services is determined by the selected plan (Free, Professional, Enterprise). § 3 Contract Conclusion The contract is concluded through registration and confirmation of the selected plan. For paid plans, activation occurs upon receipt of payment. § 4 Usage Rights MFEM grants the customer a non-exclusive, non-transferable right to use the software for the duration of the contract period. § 5 Prices and Payment Pricing is currently under development. Current information will be published on the website once available. All prices are exclusive of applicable VAT. § 6 Termination Monthly subscriptions can be cancelled at any time effective at the end of the current billing period. Annual subscriptions can be cancelled with 30 days' notice before the end of the annual term. § 7 Warranty and Liability MFEM is operated and maintained with reasonable care. The software serves as a calculation tool and does not replace professional judgment by the responsible engineer. MFEM assumes no liability for the accuracy of calculation results. MFEM's liability is limited to cases of intent and gross negligence. In cases of slight negligence, MFEM is only liable for breach of essential contractual obligations, limited to foreseeable, contract-typical damages. § 8 Data Protection MFEM processes personal data in accordance with the Privacy Policy and in compliance with GDPR. § 9 Changes to Terms MFEM reserves the right to modify these Terms. Material changes will be communicated to customers at least 30 days before they take effect. § 10 Final Provisions German law applies. The place of jurisdiction for all disputes is Munich, to the extent permitted by law. If individual provisions of these Terms are or become invalid, this does not affect the validity of the remaining provisions. As of: June 2026
